TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern the provision of services by Manawey Bodyworks ("we", "us", or "our"), a car body repair and maintenance business located at 19C Manawey Business Park, Holder Road, Aldershot, Hampshire, GU12 4RH, United Kingdom. By engaging our services, whether for car body repairs, accident repairs, dent repairs, classic car restoration, custom works, MOT testing, mechanical repairs, or any other services listed on our website, you ("you" or "the customer") agree to these Terms. If you do not agree, please do not proceed with booking or using our services.

These Terms form a legally binding contract between you and Manawey Bodyworks. We reserve the right to update these Terms at any time, and the updated version will be posted on our website. It is your responsibility to review them periodically.

1. Booking and Acceptance of Services

  • Quotations and Estimates: All quotations and estimates provided (whether verbal, written, or via email/WhatsApp) are non-binding and subject to change upon inspection of the vehicle. We aim to provide accurate estimates, but final costs may vary based on unforeseen damage or additional work required. We will notify you of any changes before proceeding.

  • Booking Confirmation: Bookings are confirmed upon receipt of a deposit (if applicable) or your explicit agreement to proceed. We may require a deposit of up to 50% of the estimated cost for larger jobs, which is non-refundable if you cancel within 24 hours of the scheduled start date.

  • Service Scope: Services are limited to those agreed upon in writing (e.g., via email or WhatsApp). Any additional work requires your prior approval and may incur extra charges.

  • Vehicle Collection and Delivery: If we arrange collection or delivery, this is at an additional cost unless otherwise stated. You must ensure the vehicle is insured and roadworthy for transit.

2. Payment Terms

  • Pricing: All prices are quoted in British Pounds (£) and include VAT at the prevailing rate (currently 20%). We reserve the right to adjust prices for material cost increases beyond our control.

  • Payment Methods: We accept cash, bank transfer, credit/debit cards (excluding American Express), and contactless payments. A 3% surcharge applies to credit card payments.

  • Payment Due: Invoices are due upon completion of the work or as specified in the quotation. For insurance or fleet work, payment terms may be extended to 30 days, subject to credit approval.

  • Late Payments: Overdue accounts may incur interest at 8% above the Bank of England base rate, plus reasonable recovery costs. We reserve the right to retain your vehicle until full payment is received.

  • Refunds: Deposits and payments are non-refundable except in cases of our material breach or as required by law. Any warranty claims do not entitle you to refunds unless the work is defective.

3. Vehicle Ownership and Liability

  • Proof of Ownership: You must provide proof of ownership or authorisation (e.g., V5C logbook or written permission from the owner) before we commence work. We accept no liability for work performed on unauthorised vehicles.

  • Risk and Storage: Risk in your vehicle remains with you at all times. While on our premises, vehicles are stored at your risk, and we recommend comprehensive insurance coverage. We provide basic security but are not liable for loss, theft, or damage unless caused by our negligence.

  • Storage Charges: If your vehicle is not collected within 3 working days of notification of completion, storage fees of £25 per day (or part thereof) will apply. Abandoned vehicles may be disposed of after 14 days, with costs recovered from you.

  • Insurance Work: For claims involving insurance companies, you authorise us to liaise directly with your insurer. We are not responsible for delays caused by insurers.

4. Warranties and Quality

  • Workmanship Guarantee: We provide a 12-month warranty on labour for body repairs and a 3-month warranty on mechanical repairs, covering defects arising from our work (excluding wear and tear, misuse, or accidents). Paintwork carries a 12-month anti-corrosion warranty.

  • Parts: Parts supplied by us are warranted as per the manufacturer's terms. We use OEM-equivalent parts unless specified otherwise.

  • Exclusions: No warranty applies to pre-existing damage, improper maintenance post-repair, or non-roadworthy vehicles. Classic car restorations are bespoke and warranted only against faulty workmanship.

  • Quality Standards: All work complies with British Standards (BS) and relevant MOT regulations. We strive for high-quality results but cannot guarantee exact colour matches due to variations in lighting and materials.

5. Liability Limitations

  • Our Liability: Our total liability to you is limited to the cost of the services provided. We are not liable for indirect, consequential, or incidental losses (e.g., loss of use, towing costs, or hire vehicles) unless caused by our gross negligence or wilful misconduct.

  • Your Liability: You indemnify us against claims arising from inaccurate information provided by you, including vehicle history or modifications.

  • Force Majeure: We are not liable for delays due to events beyond our control, such as strikes, supply shortages, or adverse weather.

6. Cancellation and Termination

  • Customer Cancellation: You may cancel with 48 hours' notice without charge. Cancellations within 24 hours incur a 50% deposit forfeiture; no-shows or late cancellations forfeit the full deposit.

  • Our Cancellation: We may cancel or postpone bookings due to unforeseen circumstances, offering alternative dates or a full refund of any deposit.

  • Termination: We may terminate services immediately if you breach these Terms (e.g., non-payment) or pose a health/safety risk.

7. Health, Safety, and Data Protection

  • Health and Safety: You must inform us of any hazardous materials (e.g., airbags, batteries) or defects in your vehicle. We comply with UK health and safety regulations.

  • Data Protection: We process your personal data in accordance with our Privacy Policy (available on our website) and the UK GDPR. We may share data with insurers or suppliers as necessary for your services.

  • Confidentiality: We treat your vehicle details and custom project information as confidential.

8. Complaints and Dispute Resolution

  • Complaints Procedure: Raise any issues in writing within 7 days of completion. We aim to resolve within 14 days.

  • Governing Law: These Terms are governed by English law. Disputes will be resolved in the courts of England and Wales.

9. General Provisions

  • Entire Agreement: These Terms supersede all prior agreements. No variations are valid unless in writing and signed by both parties.

  • Severability: If any provision is invalid, the remainder remains enforceable.

  • Third Parties: No third party has rights under these Terms.
